Welcome to WonderBaby AI! These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Creative Apps Lab ("we", "us", or "our") regarding your access to and use of the WonderBaby AI mobile application and web services.
By downloading, installing, accessing, or using WonderBaby AI, you agree to be bound by these Terms. If you do not agree with any portion of these Terms, you must immediately cease using the application.
1. DESCRIPTION OF SERVICE
WonderBaby AI is an entertainment and artistic visualization mobile application that utilizes generative artificial intelligence to predict future baby portraits, synthesize family feature blends, visualize growth milestone stages, and search baby name records based on user-provided photos, inputs, and parameters.
2. USER ELIGIBILITY & AGE REQUIREMENTS
- Adult Age Requirement (18+): WonderBaby AI is designed for adult parents, expecting couples, and legal guardians. In compliance with Section 9 of India's DPDP Act 2023 (which defines any individual under 18 as a child) and international standards, you represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction).
- Parental & Guardian Authority: If you upload photos or information of a minor child (such as for sibling prediction or growth milestones), you explicitly represent and warrant that you are the lawful parent or legal guardian with full legal authority to grant consent on the child's behalf.
- Unaccompanied Minors: Unaccompanied children under the age of 18 (in India) or 13 (under US COPPA) are strictly prohibited from using the service independently.
3. ENTERTAINMENT & VISUALIZATION DISCLAIMER
- No Genetic or Biological Guarantee: WonderBaby AI is created strictly for fun, entertainment, and artistic visualization. The generated baby portraits and age progressions are speculative AI simulations and do not constitute scientific, medical, or biological predictions.
- No Medical Advice: Content provided within the app (including pregnancy milestone visualizers and baby name tools) does not constitute medical diagnosis, healthcare counseling, or genetic counseling.
4. USER RESPONSIBILITIES & UPLOADED CONTENT
- Lawful Consent for Photos: You represent and warrant that you own or have obtained all necessary rights, permissions, and lawful consents to upload and process any photograph provided to the application (including photos of your partner, family members, or children).
- Prohibited Conduct: You agree not to upload photos or content that:
- Contains sexually explicit, abusive, unlawful, defamatory, or hateful material.
- Depicts individuals without their explicit knowledge and affirmative consent.
- Infringes on any third party's copyright, trademark, privacy, or publicity rights.
5. INTELLECTUAL PROPERTY & OUTPUT OWNERSHIP
- Application Ownership: The WonderBaby AI software, design system, proprietary algorithms, and brand assets are the exclusive intellectual property of Creative Apps Lab.
- Your Generated Output: Subject to your chosen third-party AI provider's commercial terms, you retain personal, non-commercial ownership of the artistic portrait outputs generated through your valid usage of the app.
6. API KEYS, BYOK & THIRD-PARTY SERVICES
- BYOK Key Management: If you use the Bring Your Own Key (BYOK) architecture, you are solely responsible for obtaining and securing your API keys from third-party AI providers (Google Gemini, OpenAI, Claude, OpenRouter).
- Direct Billing: Any consumption fees incurred on your third-party AI accounts are billed directly by your AI provider. Creative Apps Lab is not responsible for third-party billing, rate limits, or provider service availability.
7. PRIVACY & DATA PROTECTION COMPLIANCE
Your privacy is governed by our official Privacy Policy, which is incorporated by reference into these Terms. We process personal data in strict compliance with the **Digital Personal Data Protection Act 2023 (DPDP Act, India)**, **GDPR (European Union/UK)**, and **COPPA / CCPA (United States)**.
8. DISCLAIMER OF WARRANTIES
WONDERBABY AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CREATIVE APPS LAB DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL HARDWARE CONFIGURATIONS.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATIVE APPS LAB, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.
10. MODIFICATIONS TO TERMS
We reserve the right to modify or update these Terms to reflect legislative changes (such as new DPDP Act rules) or feature enhancements. Updated versions will be published within the app and website. Continued use of WonderBaby AI following updates constitutes your acceptance of the revised Terms.
11. GOVERNING LAW, DPDP GRIEVANCE & DISPUTE REDRESSAL
These Terms shall be governed by applicable national and state laws. In India, data protection disputes and Data Principal grievances are addressed in accordance with the Digital Personal Data Protection Act 2023:
