1. DESCRIPTION OF SERVICE

WonderBaby AI is an entertainment and photo-visualization mobile application that utilizes generative artificial intelligence to predict future baby portraits, synthesize family photos, create pregnancy milestone visual artwork, and search baby name databases based on user-provided photos and parameters.

3. USER RESPONSIBILITIES & UPLOADED CONTENT

• Ownership of Photos: You represent and warrant that you own or have obtained all necessary rights, permissions, and consents to upload and use any photo provided to the application (including photos of yourself, your spouse, or family members).
• Prohibited Content: You agree not to upload photos containing:
  • Sexually explicit, illegal, defamatory, or hateful content.
  • Photos of individuals without their explicit knowledge or consent.
  • Infringement on any third-party intellectual property or copyright rights.

4. INTELLECTUAL PROPERTY RIGHTS

• Application Ownership: The WonderBaby AI software, design system, user interface, brand assets, and code are the exclusive property of Creative Apps Lab.
• Your Generated Output: Subject to your chosen AI provider's license terms, you retain ownership of the output images generated through your usage of the app for personal, non-commercial use.

5. API KEYS, BYOK & THIRD-PARTY SERVICES

• API Key Responsibility: If you choose to use the Bring Your Own Key (BYOK) functionality, you are solely responsible for maintaining the confidentiality and management of your API keys obtained from third-party AI providers (Google Gemini, OpenAI, Claude, OpenRouter).
• Third-Party API Billing: Any costs incurred directly through your third-party AI provider accounts are your sole responsibility. Creative Apps Lab is not responsible for third-party API fees or service interruptions caused by third-party providers.

6. DISCLAIMER OF WARRANTIES

WONDERBABY AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CREATIVE APPS LAB DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATIVE APPS LAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.

8. MODIFICATIONS TO TERMS

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting an updated version within the app or on our website. Your continued use of WonderBaby AI following any updates constitutes your acceptance of the revised Terms.
